    Nine month old dies after 'babysitters injected his 17lb body with heroin and cocaine to his feet and hands'

    A couple have been accused of killing a nine-month-old baby boy by injecting her with heroin and cocaine.

    Oscar Sanchez-Rivera, 24, and Viameri Santana-Berrios, 27, were babysitting the boy when he died from a drug overdose.

    Doctors found needle marks on his hands and feet as well as undigested heroin and cocaine in his body.
    A medical examiner told a court in Philadelphia that the young victim, Milton Rojas, had so many drugs in his body that he likened him to a drug mule - the slang for someone who smuggles drugs in their body.
    The shocking details of the baby boy’s death were revealed at a preliminary hearing in Philadelphia where a judge ordered Sanchez-Rivera, 24, to stand trial on murder.
    His girlfriend Santana-Berrios will go on trial on third-degree murder charges following a five hour hearing into the circumstances of the boy’s death.

    Paramedic Dale Schroder told the court that he recognised 'track marks' normally found on drug addicts when he was trying to revive the baby.
    He said he had been called to the home last July after the baby was reported as being unresponsive.

    Schroeder said Santana-Berrios led him to a bedroom where he saw Sanchez-Rivera standing over the body of a baby who was naked and lying on a towel on the bed.

    The child was cool to the touch, pale, and unresponsive, and Schroeder's said his efforts failed to revive the child.

    Schroeder said he and his partner took the child to St. Christopher's Hospital for Children, where he was pronounced dead.

    At the hospital, the paramedic added, Milton's internal body temperature was already too low to register on a rectal thermometer.

    Medical examiner Lieberman Edwin said an autopsy showed eight needle marks on the feet and hands as well as heroin and cocaine still undigested in the child's stomach.

    Lieberman said he had never seen this level of drugs before in a child.

    Both defendants gave statements to detectives that claimed the baby, who had a history of breathing problems, began snoring, stopped breathing, and turned blue.

    The pair were looking after the boy for Iris Rojas.

    Defence lawyers blamed her for the overdose, but prosecutor Kirn told the court the victim died within six hours of being injected.

    She said: 'For 39-1/2 hours, this baby was in the care of these two people.

    'Take a look at the math and at the level of care and how they acted. The body has track marks. Track marks on a baby.'

    Municipal Court Judge James M. DeLeon ordered Sanchez-Rivera to be held on a murder charge as well as conspiracy and child endangerment.

    The judge held Santana-Berrios, a mother of two, on third-degree murder and a related charge and she was given bail of $150,000.

    For all of you out there that think that is out of line, sorry, anyone who does this to a child........a baby, they are not worth life, in a sentence or life itself. This is sick and makes me angry. Days, weeks, months, years after I have read this I am going to feel the same.

    Capital punishment is harsh, and I can understand some arguments against it, but common, doing this to a 9 month old............

    I know, its utterly disgusting that anyone would even think of doing this let alone actually do it. Track marks on a 9 month old?? Jesus, if they did it they deserve to have the book thrown at them, what gives people the right to do sick shit like this?

    I read this and couldn't believe it, vile vile thing for someone to be doing, babysitting and doing this to someone elses child? I feel so sorry for the mother but surely she must have known what these two people were like??

    Looks like they'll be facing 5-40...third degree murder my ass. If that doesn't scream 1st degree murder idk what does. I hope they trump up the charges even higher. As far as I know Pennsylvania has a death sentence...

    I'm not sure about this one, disgusting as it sounds but why would the baby have undigested cocaine and heroin in its stomach but died from an injection six hours before; the child was in care for 39.5 hrs. Needle sticks in the hands and feet wouldn't represent track marks in 39.5 hrs.

    It is a horrible article and if it is true that this infant succumbed to overdose from the cocktail described then let justice weigh upon them.

    Maybe they force fed the baby after realising they had injected a lethal overdose? I don't know but yes, lets hope justice prevails for whoever was guilty. Still shocked about this article :/

    these people should be skinned alive im a mommy and my son is 81/2 months old and when i read this i ran over to him and hugged, kissed, and loved on him and i told him honey we are having a moment for that poor little baby i wish i could give him the love and PROTECTION that he deserved what the f@#$ is wrong with people...as i was holding my child i thanked god for my 2yrs of sobriety even though in my worst days of drug use i never even came a little bit close to living a life where something like that could happen, but wow im so happy i can be a good sober mommy...every child is precious and they cant defend themselves against MONSTERS like these people...my heart hurts for him but now god and the angels are holding him close and i know this sounds bad but atleast he just went to sleep and didnt wake up an overdose is not the most painful thing to happen still unacceptable to the highest regard

    I fail to understand how anyone can ever hurt a baby.
    Sadly, I can imagine how it started. I'm certain there was a similar case in the UK, but it was the parents, not minders.

    They're higher than clouds and the baby cried, as they do. Nappy dry?, not hungry?, teething?, missing Mummy?, feeling a little scared?, here pumpkin, let me give you some of my medicine. Now leave us in peace to our indulgences.

    Nearly two days. Poor little poppett. Where was the mother?. That'll come out at trial.

    The baby cannot be brought back to life. R.I.P little one.

    I must have been too selfish as a junkie - I wouldn't have given away ANY of my drugs! Particularly to an infant who can't really enjoy it. *smirk*

    On a serious note - wtf? Even if, say, the baby won't stop crying & you're a fucking idiot...why feed it heroin AND cocaine? Cocaine isn't gonna calm him down! *rolls eyes* After all, EVERYONE knows you calm babies down with alcohol! *sheesh*

    Anyway. What's up with mommy that she needed a babysitter for nearly 2 days (probably longer, had the baby survived his vicious, disgusting "sitters")?

    As he worked on the naked body of Milton Galarza-Rojas, Philadelphia paramedic Dale Schroeder said he recognized something he'd seen many times before: "track marks," the small bruises that mark the bodies of regular injection drug users.

    Problem was that little Milton, all 171/2 pounds of him, was just 9 months old.

    On Tuesday, almost 12 months after the Hunting Park child was declared dead, a Philadelphia judge ordered Milton's aunt and her boyfriend to stand trial for murder for overdosing Milton with cocaine and heroin.

    Lawyers for Oscar Sanchez-Rivera, 24, and Viameri Santana-Berrios, 27, strenuously contested the charges during a five-hour preliminary hearing before Municipal Court Judge James M. DeLeon.

    "There is nothing to indicate that my client ever injected this child with anything at any time," said F. Michael Medway, the attorney for Sanchez-Rivera.

    Though Sanchez-Rivera is an admitted heroin user, Medway argued that it made no sense for him to inject and kill a child who was not his and whom he and his girlfriend were only watching. "Why? Because the kid is too much of a pain?" Medway asked.

    Santana-Berrios' attorney, Rania M. Major-Trunfio, made a similar argument, telling the judge that neither the autopsy nor any witnesses could show that Santana-Berrios injected drugs into the infant she was watching for her cousin.

    But Assistant District Attorney Bridget Kirn cited the testimony of Assistant Philadelphia Medical Examiner Edwin Lieberman, who said the drugs in Milton's body had to have been ingested or injected within six hours of death.

    "For 39 & 1/2 hours, this baby was in the care of these two people," Kirn argued. "Take a look at the math and at the level of care and how they acted. The body has track marks. Track marks on a baby."

    DeLeon agreed with Kirn: "It comes down to the six hours before the child died."

    DeLeon ordered Sanchez-Rivera held on a general charge of murder, conspiracy, child endangerment, and related counts.

    The judge held Santana-Berrios on third-degree murder and related charges. The lesser homicide charge made the mother of two - an 8-year-old boy and a 5-year-old girl - eligible for bail, and DeLeon set bail at $150,000.

    Schroeder, the paramedic, testified that he and his partner responded to a 911 call at 2:36 a.m. on July 26, 2011, at an apartment in the 4500 block of North Seventh Street.

    Schroeder said Santana-Berrios led him to a bedroom where he saw Sanchez-Rivera standing over the prone body of a baby who was naked and lying on a towel on the bed.

    The child was cool to the touch, pale, and unresponsive, and Schroeder's efforts failed to revive the child in the ambulance. Schroeder said he and his partner took the child to St. Christopher's Hospital for Children, where he was pronounced dead shortly after 3 a.m. At the hospital, the paramedic added, Milton's internal body temperature was already too low to register on a rectal thermometer.

    Lieberman testified that the autopsy showed eight needle marks on the feet and hands as well as heroin and cocaine still undigested in the child's stomach.

    Questioning witnesses, the defense lawyers each suggested the other's client could have given the child the drugs. They also implicated the boy's mother, Iris Rojas, cousin of Santana-Berrios, whose house collapsed and who had left Milton in her cousin's care.

    But the judge returned to who was caring for Milton: "You start with nothing's the matter with the kid and then the kid drops dead. And there's nothing, nothing you did to put the child in harm's way?"

    Where is the mother (and maybe father) that left the child in the care of these people? I'd bet she will be facing some criminal charges as well.

    This is shocking to me, and I was a social worker that dealt with abused children. I have never heard of anything like this and I have heard/seen some very screwed up things.

    I can only think that they gave the wee mite some gear to get him to sleep then when he was going over some coke to try and counter act it. Sure kids can be annoying but using drugs to zonk them seems extreme. Poor kid!
    The judge surely has to sentence both of the guilty...I mean defendants...no I don't, I mean the guilty parties.

    I can't remember the TV show but there was a quote that I'll paraphrase
    "you need a licence to own a dog but they will let any idiot have a baby"
    it seems quite apt here.

    Possibly, but if they were addicts anyway they would have known that injecting crack or whatever wouldn't have helped, naloxone is the one to boot off the opiates.

    But even if they had only done this to get the kid off to sleep WTF was with injecting it?? Jesus, and not just one injection site either, trackmarks... so not even done the once.

    This thread disgusted me back in July and it still does. Appalling behaviour.

    I guess the numerous track marks were because they kept the poor lad out cold all of the time.

    You think you have seen the worst that humanity has to offer and sadly something more shocking always comes around the corner.
    I hope that when they are sentenced they go into the prison's general population and not some protected wing.
