Ohio boy comes home to find halls decked, strung-out stranger watching TV

Snorting bath salts put one Ohio crook in the holiday spirit, police say.

Cops in Vandalia, north of Dayton, say Terry Trent, 44, was high on the designer drug when he broke into a family’s home, put up some Christmas decorations and then plopped down on a couch to watch television, local station WHIO reported.

An 11-year-old boy who lives in the house found the strung-out stranger and called his mother, Tamara Henderson, who was at a neighbor's house.

She said, "What do you mean a man is in our house? You don't know if he has a gun or if he has a knife?" the station reported.

Henderson called 911, and Trent was arrested without incident.

Cops say he was armed with a pocket knife.

But Henderson suspects the decorating bandit was just looking for a festive spot to soak in his buzz.

"The candle was lit on the coffee table, the television was on and very loud," she told the station.

"He had said to [my son] ,'I'm sorry. I didn't mean to scare you. I'll get my things and go.' "

Trent was charged with burglary and held in a county lockup.

Cops say he has a history of drug charges.

Burglary? I thought that meant you had to have the intention of stealing something.... Couldn't they just charge him with trespassing or something? I wonder what he was on...

Yeah, burglary is a bit much if you ask me. Idk, maybe he was a psycho? We may never know.

I'm not sure how the law works there regarding "breaking and entering" as it would be called here, but his consumption of "bath salts" and "history of drug charges" might have prejudiced the police's handling of this man to the extent of charging him with burglary.
Nowhere in the article does it mention that he was in possession of any illegal substance(s).

Dad comes home and sees the christmas decorations are already up.
Mom explains the situation and dad asks if everyone is okay.
    They now have 2 choices-
Leave the decorations up until X-mas
    Or take them down.
Why take them down? christmas is only a month away and your just going to have to put them up anyways.
The should leave them up and send a thankyou card to the guy for saving them the trouble.

On a serious note- The guy shouldn't have been charged with burglary.
And what if the front door was open... Can one be charged with just "entering"?
He should be charged with trespassing. There's just no way they could prove he intended to steal anything. I mean, com'on, what kind of person puts up decorations only to turn around and steal them? Doesn't make sense to me.

Definatly just charge him with trespass.
This gave me a good laugh! Hopefully the child isn't shaken.

Isn't trespassing related to land, while burglary relates to unlawful entrance of a building? Breaking and entry are related in law. Unlawful entry does not exist without breaking. There is also the unlawful act of Dwelling if the person lives in the neighborhood. Some districts have degrees of burglary.

What about serious criminal trespass? Or would that be worse punishment wise?

Criminal trespassing would most likely be part of the plea bargain threw out the court process along with drug rehab. As long as he didn't eat anything or take anything from the family while he was there he may get a deal. This also will depend heavily on his prior criminal record. You always get charged with heavier offenses no matter what the crime is. It is up to the States Attorney to decide whether they have a case for those charges or have to offer a deal for a lesser crime to try for the conviction.

This is kind of precious, in a sick, twisted way.

"Fuck! I have all this energy & nothing to focus it on. Dammit! Hey, wait...those people don't have their Christmas decorations up, like all their neighbors. I wonder if they're Jewish? Hmm, Jesus was Jewish too - I wonder if he gets annoyed that (some) Christians think they're "better" than Jews, considering he's Jewish. Huh."

*notices door's unlocked, sees boxes marked 'XMAS' stacked near garage door*

"Oh, they're not Jewish. Hey, I've got nothing better to do!"

    *decks the halls*

"This is a pretty nice house, especially all decorated for the holidays like this! I think I'll sit down & admire my efforts!"

*makes hot cocoa, lights candles, turns on TV. smiles faintly to himself as he stares at infomercials*

    *little boy walks in*

"Oh, hey there, kiddo. Um, didn't mean to freak you out or anything, just had some extra energy & nothing else to do & thought y'all could use some help with the decorating. I see I'm tweaking you out - I'll just go. Happy Holidays! There's fresh mint cocoa on the stove!!"

    *end scene*

    *lol*
