    A Willoughby man is accused of raping a woman in a Bowling Green State University dorm room while both were under the influence of LSD.

    John McCullough, 25, went on trial Tuesday before Wood County Common Pleas Judge Reeve Kelsey on four counts of rape, possession of LSD, abduction, trafficking in marijuana and possession of drugs.

    According to the Sentinel-Tribune Daily Newspaper in Bowling Green:

    MucCullough raped the 19-year-old freshman on April 8, 2010, while two of her male friends — who also used LSD — were in the room.

    The alleged victim testified that if she tried to yell for help, the defendant would grab her throat.

    She also admitted the drug “somewhat impaired” her thinking. In addition, her friends were only a couple feet away from the assault, but were wearing headphones and could not hear the attack, she testified.

    Defense attorney Scott Coon is arguing the sex was consensual. He showed the jurors security camera footage from the dormitory hallway showing the woman leaving the room five times during the alleged time of the rape. Coon also provided records to show the woman made or received 12 calls from her cell phone during that time — none to 911.

    The trial is scheduled to last four days.

    Victim testifies in BGSU rape case

    BOWLING GREEN, Ohio - Jury to decide whether rape, or consensual sex, occurred in a dorm: Violent rape or post-encounter regret? That is the basic decision being put before a jury in a trial which began Tuesday in the Wood County courtroom of Judge Reeve Kelsey.

    John McCullough, 25, of Willoughby, faces eight charges in relation to events which occurred April 8 and 15, 2010.

    He is charged with four counts of rape, including one of those with impairment; possession of LSD; abduction; trafficking in marijuana and possession of drugs.

    The rape is alleged to have occurred in a Bowling Green State University residence hall room and involved a then 19-year-old woman. Other charges stem from a meeting set up with police which occurred a week later, for the defendant to supposedly meet with the victim.

    The alleged victim was the first and only witness to testify on Tuesday. She provided many details of the night in question. However, there were also many events where she could not recall the details.

    but something that is the truth is not going to create evil
    dollars to dreadlocks that,if guilty, those are not first time predators(although never caught) and probably set fires hurt animals and/or peed the bed.

    Me too, couldn't agree more. But I'm also not a fan of women accusing someone of rape just because she realized she was a huge slut. I'm not saying she wasn't raped, certainly not my place to judge that. But the defense has some really good back up...video evidence of her leaving and returning with no distress and cellphone records showing no calls for help.

    Seems extra fishy to me.

    People do weird, stupid shit on acid all the time. But forcing yourself and violently attacking someone under the influence of only LSD....is a bit beyond my ability to wrap my head around.

    I also find that hard to believe but what if the guy had a paradoxical reaction (i think thats the word) and instead of making him a caring, loving individual it turned him into a sex crazed hooligan, which if it did happen implies he probably had a pre-existing mental disorder. This seems like a open and shut case to me. I don't know about anyone else but if *I* were being raped one of those 12 calls would have been to 911 if not all of them. If its a post-encounter regret I have absolutely no sympathy for her. Trying to get someone convicted of rape because your depressed you were being a slut demands she be labeled a sex offender. Jesus this grosses me out. People are terrible.

    Swims friend has to agree that if this did happen, sexual predator is always gonna be a sexual predator as V-S said. But this just doesnt add up.

    It sounds like it might be a case of her trying to not look like a slut. As swiy guy said before. Who knows she may have a boyfriend and after that, thought it might be a better idea to just take this guy down. If swims friend was on LSD and getting raped. He would probably be even more terrified than in a normal state. But it doesnt sound like that was the case at all with her.

    LSD wouldn't make a person just calmy go about there trip after experiencing that. And who would even try to rape someone when there is two people feet away listening to music.

    Just doesn't add up, but who knows it couldve happened. Either way someone is doing something very wrong right now. Evil is a good way to put it.

    I don't understand where this girl was "being a slut". If it's post-sex regret, that's fine (I mean having post-sex regret is fine, not fucking deciding to scream rape regarding it). Someone wanting to get laid doesn't mean they're a slut.

    I just have a problem with the slut language. If I banged 3 guys this weekend, I'd be called a slut, if a guy banged 3 girls this weekend he'd be congratulated by his friends. I just abhor the double standard. Fuck, people will call me a slut because I fuck only one guy but will do it 8 times a day. That's ridiculous.

    So, can we please stop calling her a slut?

    She's a fucking vicious asshole if she's calling rape because she regretted fucking this dude (in front of her friends, no less).

    I used the term slut because if its post-encounter regret, it would clearly be offending her own moral code.

    Defying ones own moral code, then retracting, would be admitting what she did was "slutty". Not by anyone else standards but her own. If she didnt believe she was being slutty (and it was indeed consensual), there wouldnt be a problem.

    There is also the idea that if its post-encounter regret, maybe not defying her own moral code, but rather fear of the rumor mill, of course the word used most would be slut. That is, if consensual, clearly what she wants to avoid.

    I have no judgments on what people, male or female, want to do with their sexuality. But in this case, as said if it was consensual, slut was already the word going through her head.

    Edit: I also think its a bit unfair to assume posters above wouldn't call the guy a slut, too, had the roles been reversed.

    The rape accusation certainly sounds weak enough, but where the hell is this abduction charge coming from? Based on the two articles, she is the student, and I'm assuming that the alleged assault occurred in her dorm. Dorms are pretty secure. How can there be an abduction if she or one of her friends invited these guys over to party?

    Also, why did they wait an entire week, ultimately using the alleged rape victim as bait, to arrest the suspect? Was it a sting to purposely add the drug charges?

    They are really trying to shaft this guy.

    McCullough cleared of rape, guilty of drug charges

    After what one juror described as a "very difficult" deliberation Friday, a jury found John McCullough guilty of three drug-related offenses, found him not guilty of abduction and not guilty of rape under impairment.

    On three other counts of rape by force, the jury of eight men and four women were unable to reach a verdict. The decisions came in after 7 p.m. Friday.
    McCullough, 25, of Willoughby, faced eight counts for actions which took place April 8 and 15, 2010.

    Juror Terry Brown of Rudolph, said "it was a very difficult decision. Most of the time we spent was on those three subjects (the rape counts)." The jurors spent almost nine hours deliberating.

    When McCullough was arrested exactly one year ago Friday, drugs were found in his car. He was convicted of possession of LSD and possession of psilocilin [sic], often called "mushrooms." The jury also convicted him of trafficking in marijuana; eight small bags were found in his car.

    "We all knew why he was here," Brown said of the drug convictions.
    All 12 jurors also agreed the state did not prove that McCullough held the alleged victim against her will or that he raped her while under impairment.
    The crimes were allegedly done in a residence hall room on the Bowling Green State University campus.

    Security footage from the hall outside the room showed the alleged victim, defendant and two witnesses for the prosecution coming and going from the room multiple times during the time frame of the offenses.

    Because there is a significant time period when there was no activity in the hallway, there was not clarity as to the authenticity of the other charges.
    Brown said the final vote was four guilty of the rape charges, with eight siding with the defendant.

    He also said that the small size of the room, the victim's frequent use of a cell phone, and other opportunities to seek help or escape, all weighed into deliberations.

    During the course of the trial, the alleged victim, the two friends who were present in the room at the time of the alleged offense, along with the defendant were all shown to have lied to investigators or police in the case. Both the prosecution and the defense attorneys admitted to such during closing arguments Friday morning.

    Because of the hung jury, Judge Reeve Kelsey allowed two weeks for Heather Baker, the lead prosecuting attorney on the case, to decide if she'll proceed with a new trial.

    There was also a pre-trial set for April 28 at 3:30 p.m.

    Because of the trafficking conviction, McCullough's vehicle is subject to forfeiture. The judge will rule on that later.

    Kelsey released McCullough on his own recognizance beginning Monday, on the condition he stay at his mother's residence in Willoughby.

    The judge also ordered that he have no contact with the victim and any of the witnesses in the case, and stay away from the BGSU campus.

    A pre-sentence investigation was ordered with sentencing scheduled for June 20 at 9 a.m.
