Supreme Court of Canada ruling on Insite safe injection facility

    The 30 Sept 2011 decision by the Supreme Court of Canada ordering the Minister of Health to keep Insite, a safe site for injection drug users in Vancouver, BC, alive. It can only operate if exempted from federal drug law by the Minister of Health, and then Health Minister Tony Clement attempted to pull the plug on Insite years ago.

    In a 9-0 decision, the Court ruled that Clement's refusal to grant Insite an exemption deprivied individuals of their right to life, liberty and security of the person in a manner that violates the principles of fundamental justice, and was therefore a violation of the Charter of Rights and Freedoms, Canada's highest law.

    This ruling is a huge victory for public health and a massive slap to the federal government.
